Understanding Chapter 7 and Chapter 13 Bankruptcy

In discussing your financial situation, we can determine whether you are eligible for either Chapter 7 or Chapter 13 bankruptcy. Both types of bankruptcy create an automatic stay which immediately halts all collection activity against you, including home foreclosure.

  • Otherwise known as liquidation, Chapter 7 bankruptcy will discharge most unsecured debt, such as credit card debt, medical bills, and payday loans. State and federal exemptions generally allow people to keep their home and other personal property, providing that payments are kept current.
  • In Chapter 13 bankruptcy, the court reorganizes the debt into a three-to-five year payment plan. Once the payment period is complete, all remaining unsecured debt is discharged. Chapter 13 is an option for people that do not qualify for Chapter 7 under the means test.
